Overview

This website, turfbird.us, is operated by TurfBird LLC ("TurfBird," "we," "us," or "our"). By visiting the site or buying from us, you agree to these Terms of Service. If you don't agree, please don't use the site. Our store runs on Shopify, and our products are made to order by our production partner, Printful.

1. Accuracy of information

We work hard to keep product descriptions, photos, mockups, and size guides accurate, but we can't guarantee every detail is error-free, complete, or current. Because every item is made to order, colors may look slightly different from screen to screen, and print or embroidery placement can vary slightly from piece to piece. That's normal for made-to-order apparel and isn't considered a defect.

If we find an error (including a pricing error), we may correct it, update the information, or cancel affected orders, even after you've placed an order.

2. Pricing and availability

Prices are listed in U.S. dollars and can change without notice. Products, colors, and sizes may be added, changed, or discontinued at any time. Shipping is calculated at checkout, and sales tax is collected where required by law.

3. Orders, and our right to refuse or cancel

Placing an order is an offer to buy. We may refuse, limit, or cancel any order for any reason, including suspected fraud, unauthorized or resale purchasing, product unavailability, or errors in pricing or product information. If we cancel an order you've already paid for, we'll refund you in full.

Since items go into production quickly, we may not be able to change or cancel an order once it's placed. Contact us right away if you need help.

4. Payment

Payment is due when you place your order. You agree to provide current, complete, and accurate purchase and account information, and you confirm that you're authorized to use the payment method you provide. Payments are processed securely through Shopify and its payment partners; we don't store your full card details.

5. Returns and refunds

All sales are final, with limited exceptions for damaged, misprinted, wrong, or lost items. Please read our Refund Policy for the full details.

6. Intellectual property

The TurfBird name, logos, designs, artwork, graphics, photos, and text on this site belong to TurfBird LLC or are used with permission, and are protected by copyright and trademark laws. Buying a product doesn't give you any right to reproduce, sell, or otherwise use our designs or branding. You may not copy, modify, or use any of our content for commercial purposes without our written permission.

7. User conduct

When using our site, you agree not to:

  • use the site for anything unlawful or fraudulent;
  • infringe our intellectual property or anyone else's rights;
  • harass, abuse, or threaten anyone, or submit false or misleading information;
  • upload or transmit viruses or other malicious code;
  • scrape, data-mine, or interfere with the site's security or normal operation.

We may restrict or end your access to the site if you break these rules. If you send us comments, reviews, or ideas, you agree we may use them without any obligation to you.

8. Third-party services and links

Our site relies on third-party services (such as Shopify, payment processors, Printful, and shipping carriers) and may link to other websites. We aren't responsible for third-party sites or services, and your use of them may be subject to their own terms.

9. Disclaimer and limitation of liability

The site and our products are provided "as is" and "as available." To the fullest extent allowed by law, we make no warranties beyond those stated in our policies, and we don't guarantee the site will be uninterrupted or error-free.

To the fullest extent allowed by law, TurfBird and its owners, employees, and partners won't be liable for any indirect, incidental, special, or consequential damages arising from your use of the site or our products. Our total liability for any claim related to a product won't exceed the amount you paid for that product. Some states don't allow certain limitations, so some of these may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless TurfBird and its owners, employees, and partners from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your violation of any law or the rights of others.

Your use of the site is also governed by our Privacy Policy, which explains how we collect and use your personal information.

12. Governing law

These Terms are governed by the laws of the State of Indiana, USA, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Indiana.

13. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on this page. Continuing to use the site after changes are posted means you accept them.

14. Severability

If any part of these Terms is found unenforceable, the rest stays in effect.
